By accessing and using the services provided by Alphard IT Solutions LTD ("we," "our," or "us"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our services.

Alphard IT Solutions provides:

• Custom software development
• IT talent marketplace and recruitment services
• Technology retail through our partner e-commerce platform

IT Services: All IT services are provided on a best-effort basis. We will use reasonable skill and care in providing services but cannot guarantee specific outcomes or uptime.

Talent Marketplace: We facilitate connections between employers and IT professionals but are not responsible for the outcome of any employment relationships formed through our platform.

E-commerce: Product purchases are processed through our WordPress/WooCommerce partner platform. All sales are subject to their terms and conditions.

• Payment is due as specified in service agreements or invoices
• Late payments may incur additional charges
• We accept various payment methods including M-Pesa, bank transfers, and card payments
• Refunds are subject to our refund policy and the nature of services provided

You agree to:

• Provide accurate and complete information
• Maintain the confidentiality of any account credentials
• Use our services only for lawful purposes
• Not interfere with or disrupt our services
• Respect intellectual property rights
• Comply with all applicable laws and regulations

We understand that in providing IT services, we may have access to your confidential information. We commit to:

• Maintaining strict confidentiality of your business information
• Using information only for the purpose of providing services
• Implementing appropriate security measures
• Not disclosing information to third parties without consent

To the maximum extent permitted by law:

• Our liability is limited to the amount paid for the specific service
• We are not liable for indirect, incidental, or consequential damages
• We maintain professional indemnity insurance for our services
• Some limitations may not apply to consumer contracts under Kenyan law

• Custom software or solutions developed remain our intellectual property unless otherwise agreed
• You retain ownership of your business data and information
• We may use anonymized data to improve our services
• Our website content, logos, and trademarks are protected by intellectual property laws

Either party may terminate services with appropriate notice as specified in service agreements. Upon termination:

• Outstanding invoices remain payable
• We will return or securely destroy your confidential information
• Certain provisions of these terms will survive termination

These terms are governed by the laws of Kenya. Any disputes will be resolved through the courts of Kenya or through mutually agreed alternative dispute resolution methods.

We may update these terms from time to time. Significant changes will be communicated to you via email or through our website. Continued use of our services constitutes acceptance of updated terms.
